I started the website last night. My buddy was hooked on the game then their server crashed. I quickly purchased the domain and built the site. Within minutes of installing wordpress I had thousands of people on the server. The site is constantly growing as well as the social media pages I just created.

Can you estimate the legal costs the buyer might incur defending themselves from Nintendo?
@sitebuyers I'm def not an attorney so I have no idea. However I know a funny instance and example "Sluts of Instagram " aka "Stusof in Stagram " www.slutsofintagram.com was a very classic way to spin it worst case. I figure if you make it into a blog and just collect classic photos of people using the app, there should be no harm. If you try to make money and infringe on the game, you probably would get in trouble
@shipyourglitter Funny enough I actually have a decent idea for this site like that. I doubt it would be worth what someone ultimately ends up paying for this site though.
@sitebuyers that's awesome! I've thought of a few classic ideas. I think making it a blog with user generated content of people's screen shots, funny stories, etc. would be huge. Then just make $$ as a Google double click publisher and run non stop traffic via social media.

@Macab05 It using a service from www.theprintful.com (The Printful) You just upload the creative and choose what type of product you want it on. When orders are placed they will include your logo and looks 100% like you did it. You can even manually upload from your phone. I do it on other sites like www.dropadeuce.org
How did you market the website to get 3k user per day ?
@megacoolx it's mainly organic traffic. When the actually Pokemon Go game crashes you see a lot of people searching for why, help, tips, tricks, cheats. I've been doing some SEO but not much. I also tested some Google PPC campaigns at a $10 daily budget, some social media post, this flippa listing and Facebook groups.
Can you post updated Adsense and Propeller?
@templeofgroove - Sure no problem. I took Propeller off the site because I was getting such bad bounce rates and people were getting super annoyed from their virus like pop up ads. Ill post an update of all traffic tomorrow morning for you.

Hey, I offer you a BIN price yesterday via PM. Please disregard the offer, I spoke with my attorney about the opoortunity and after reviewing Nintendo filed the first days of March the pokemon name, colors and logo including any typo in the name.
It looks it is on revision now but this site will be under their copyright and trademark rights as it is using the logo, the colors of the brand and also the missleading typo in the name of the website and the domain name.
I didnt spoke about the products included for selling but just the site amd was advised that currently is not ilegal as it is on revision but as soon the process is approved it will be a potential legal issue with Nintendo.

You can deal with the company directly to sell the domain now as it is not trademark approved and maybe get good profit from the sale but after is trademarked it will be hard as happened before with other domains like disney or DC caracthers that had the same issue.

@Isaacsach It doesn't even matter, they wouldn't buy it because he's not legally entitled to own it. The best he could hope for from is being asked nicely to hand it over. Refusing to do so would only land him in court and be forced to pay some hefty damages and legal fees.
@megacoolx - There were a few that went through, but I refunded them and I am letting people know that I am just showing an example of how it works. The image is a Free image and im using that as an example just for the purposes of showing functionality for the next owner. Im not trying to infringe at all on the game. This site is a blog about people playing the game. Of course it has tips, tricks, etc.
@sammyp Ya I had some doubts myself, but as long as I'm not infringing on the game, TM, etc it shouldn't be an issue. Hopefully the attorneys I spoke with are correct...

It's ok to own the name the guy purchase the domain and he own it fair and square the only thing he can't do is using the logo but he can do what ever he want with it.

There is no trademark infringement here. That is the reason you go through corporations such as GoDaddy who have already invested the time and money into legal logistics so that their customers are shielded from liability in regard to whatever domains are purchased. All legalities have already been sorted out through GoDaddy. Once you buy a domain it is now yours by federal law. Refer to terms and conditions when you buy any domain.
On the other hand, what you put on that site can be subject copyright liability. If, for example, you put up pokeymongo.com and on that site you sell an app that is not made by Niantic and you call it PokemonGo, then yes, Nintendo can place a grievance against you. That is pure infringement and Nintendo will demand you buy a license from them.
And if it really worries you there is liability insurance you can buy that is very cheap and will absorb much of the liability in the event of lawsuit. Refer to an attorney or business lawyer for more on this.

@templeofgroove I've never heard of that requirement. I think they have one regarding trademarks meaning it probably isn't allowed on this site anyway but on ecommerce sites in general I don't think that rule would make sense. eBay is full of Adsense ads if you didn't notice though I understand the big guys can negotiate stuff like that.
@mocbaisas That site is literally less than a week old. Does ahrefs work that quickly. What you want to ask for is his Google Analytics access then verify the visitors aren't bots.

@Isaacsach My guess is it is people searching google for pokeymongo or pokey mongo. Basically mistyped keywords. One thing I'll mention so people understand the risks here. Two years ago I bought one of those Flappy Bird websites on Flippa. Almost made my money back on a quick turnaround. But what stopped it was Google changing their algorithm shortly afterwards. My site was #1 for a common mistype when I bought it. But after about a month Google combined all the search results for all mistypes with the correct name. The result was a ranking on page 2 or 3 and my traffic cut by about 99% overnight. Whoever buys this will want to rely on direct traffic for the long term.

@Jeng8827 I haven't noticed a big change. For the most part when I turn my Google Adwords campaigns on - It gets crazy traffic instantly. I haven't really been paying attention about the SEO much since I don't plan to have the site long term. I also am testing a new monetization method to see how it works.

I've had previous legal experience in similar situation. In 1999 I purchased SocialSecurityAdministration.com (domain) I think the same day ICAAN allowed more charactersas in domain names, or very close to the same day. I purchased the domain as part of a continued strategic domain portfolio to direct traffic to an online people search company I developed in 1997. Around 2000-2002 I received a C&D letter directly from U.S attornys representing the Social Security Administration and they said people were getting confused with the real SSA and my website SocialSecurityAdministration.com and that I needed to distinguish clearly between the two sites for visitors. I complied and put some text on the site that said "this is not the official SSA website". I asked them if that was acceptable and they said yes that would be ok. Never heard from them again. They were super easy to work with. My company was later acquired including portfolio of all domains in 2005. We provided documentation to new buyers that the site was in compliance. I'm hoping to provide some helpful information here for Derick and everyone else following this auction. I can only speculate if there is infringement or not as im not an attorney.
